These Terms of Service set the rules for using the Ankhway Marketing website, including our curated directory of AI tools, our forms, and the pages that describe our marketing services. They form a binding agreement between you and us, so please read them carefully.
Three points deserve particular attention: we are not a party to your dealings with the providers of listed tools (Section 6), AI tools carry specific risks (Section 15), and our liability to you is limited (Section 18).
1. About these Terms
Who we are
Ankhway Marketing is a trade name of M&R MARKETING GROUP, LLC, whose business address is 331 3rd St, Macon, GA 31201-3312, United States. In these Terms, “Ankhway Marketing,” “we,” “us,” and “our” refer to M&R MARKETING GROUP, LLC, and “you” refers to the person using the Platform.
Accepting these Terms
By accessing or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
If you use the Platform on behalf of an organization (for example, to ask us to update your employer’s Listing), you confirm that you are authorized to accept these Terms for it, and “you” includes that organization.
Related documents
Our Editorial Policy, Advertising Disclosure, Copyright & Takedown Policy, and Disclaimer also apply and should be read together with these Terms. Our Privacy Policy and Cookie Policy explain how we handle personal information, cookies, and similar technologies. If a related document conflicts with these Terms, these Terms prevail, except where Section 10 gives priority to a separate written agreement.
2. Definitions
In these Terms:
- Platform means the website we operate under the Ankhway Marketing name, including all of its pages, forms, and content.
- Directory means the curated collection of Listings on the Platform, including its categories.
- Listing means the entry for a particular tool in the Directory.
- Provider means the company, organization, or individual that develops, operates, or sells a tool that appears in the Directory.
- Third-Party Tool means any software, app, model, website, or service offered by a Provider rather than by us.
- Submission means any information or material you send us about a tool or a Listing, such as a correction, an update, or a claim that you represent a Provider.
- Our Content means material on the Platform created by or for us, such as editorial descriptions, page text, design, generated monograms, code, and the selection and arrangement of Listings. It does not include names, trademarks, content, or tools that belong to Providers or other third parties (Third-Party Materials).
- Sponsored Placement means a placement or promotion on the Platform that a Provider pays us for, such as a sponsored slot in the Directory or a highlighted listing.
- Marketing Services means the marketing services we offer to AI and software companies, as described on our marketing services page.
- Business day means Monday to Friday, excluding US federal holidays.
Words such as “including” and “for example” introduce examples and do not limit the words that come before them.
3. The Platform
An informational directory
The Platform is an English-language, curated directory of third-party AI tools, organized into categories such as AI Assistants, Coding & Development, Image Generation, and Productivity. It also includes help articles, information about our Marketing Services, and a form for contacting us.
The Directory is provided for general information, to help you discover and compare tools. It is not a marketplace, app store, or reseller.
No accounts and no transactions
Browsing the Platform is free. There are no user accounts, logins, or profiles; visitors cannot post comments, reviews, or ratings; and we do not run a newsletter.
No purchases, payments, or checkouts take place on the Platform, including for our Marketing Services. If you decide to sign up for or buy a Third-Party Tool, you do so on the Provider’s website and under the Provider’s terms.
We will never ask you to enter payment card or bank details on the Platform. If you come across a page that appears to be ours and asks for them, please do not continue, and let us know through our contact form.
4. Eligibility
The Platform is intended for a general adult audience and is not directed at children under 16. If you are under 16, please do not use our forms or send us any personal information.
To send us a Submission or to request our Marketing Services, you must be at least 18 years old (or the age of majority where you live, if that is higher) and able to enter into a binding contract. If you act for a business, you must be authorized to act on its behalf.
You are responsible for making sure that your use of the Platform, and of any Third-Party Tool you find through it, is lawful where you are. We do not claim that any Third-Party Tool is available, suitable, or lawful to use in every country.
5. Acceptable use
You may use the Platform only for lawful purposes and in line with these Terms. In particular, you agree not to do any of the following.
Automated access and copying
- Use bots, crawlers, scrapers, or other automated means to access or copy the Platform, or download Listings in bulk, without our prior written permission. General-purpose search engines that index public pages are an exception.
- Copy the Directory, or a substantial part of it, to build a competing directory or dataset, or use Our Content to train or fine-tune machine-learning models, without our prior written permission.
- Frame or mirror the Platform, or present Our Content in a way that hides where it came from.
Security and operation
- Probe, scan, or test the vulnerability of the Platform, breach or circumvent any security or access-control measure, or try to gain unauthorized access to any part of the Platform or its infrastructure.
- Introduce malware or other harmful code, or overload or interfere with the Platform, including through denial-of-service attacks or excessive automated requests.
Use of our forms
- Submit false or misleading information, or information you are not entitled to share.
- Impersonate any person or organization, or misrepresent your connection with a Provider.
- Send spam, bulk or automated submissions, or unsolicited advertising, or try to get around our spam-prevention measures.
- Include malicious links or code, or content that is unlawful, defamatory, harassing, or hateful, or that infringes anyone’s rights.
- Make reports or takedown requests that you know to be false, or use reports to harass anyone.
Misrepresenting your relationship with us
- State or imply that we endorse, certify, or partner with you or your product when we do not, or present a Listing or an Editor’s pick as a certification or guarantee.
- Remove or hide a “Sponsored” label or other notice when you quote or refer to content from the Platform.
If you believe you have found a security weakness, please tell us through our contact form rather than investigating it further. If we reasonably believe you have broken this section, we may ignore or delete your messages or Submissions, remove related Listings, block your access to the Platform, and, where appropriate, report the matter to the relevant authorities.
6. Third-party tools and listings
Every tool in the Directory is made and offered by an independent Provider. We do not own, develop, operate, or control any Third-Party Tool, and we are not an agent or reseller for any Provider.
No endorsement
Including a tool in the Directory, making it an Editor’s pick, or labeling it “Sponsored” does not mean that we endorse, certify, or guarantee the tool or its Provider, including its quality, safety, security, privacy practices, legal compliance, or suitability for your purposes. An Editor’s pick reflects our editors’ opinion when it was chosen; it is not a warranty.
Your dealings with Providers
We are not a party to any relationship between you and a Provider. Any account you open, purchase or subscription you make, license you accept, or data you share is solely between you and that Provider, under the Provider’s own terms and privacy policy. We are not responsible for a Provider’s products, pricing, billing, refunds, support, data handling, or conduct, and any dispute about them must be taken up with the Provider.
Before using a Third-Party Tool, review the Provider’s terms, privacy policy, pricing, and security information, and decide for yourself whether it suits your needs, especially for business use, personal data, or regulated work. Where a Provider has a paid relationship with us, its Listing is labeled “Sponsored” (see Section 9).
7. Listing information and accuracy
How Listings are prepared
Listing descriptions are original text written by our editors. Drafts may be prepared with the help of AI writing tools; a human editor then reviews and edits every draft before it is published. Listings reflect information available to us when they are written or updated, such as the Provider’s public information and any Submission we have received.
We work to keep Listings accurate, but we do not independently test, audit, or verify every tool, feature, or claim. AI tools change quickly, and a Listing may become incomplete or out of date without our knowledge.
Pricing-model labels
Each Listing carries one of these pricing-model labels:
| Label | Meaning |
|---|---|
| Free | The core product can be used without paying. |
| Freemium | A free plan or free usage tier exists, with paid plans for more usage or features. |
| Paid | A paid plan is required, although a free trial may be available. |
| Open Source | The source code is publicly available under an open-source or source-available license. Hosted versions may cost money. |
These labels are indicative only. Providers change their prices, plans, free tiers, and license terms, often without telling us. Always confirm current pricing and terms on the Provider’s website before you sign up, pay, or rely on a free tier.
Other Listing details
Key features, use cases, supported platforms, tags, and “things to consider” reflect our understanding at the time of writing. The “things to consider” notes are editorial observations, not a complete list of a tool’s risks or limitations. We may correct, update, reclassify, or remove any Listing at any time without notice. If you spot an error, please let us know (see Section 13).
8. Listings and Submissions
How tools are chosen
Our editors decide which tools appear in the Directory, based on their own research and the criteria in our Editorial Policy. We are not accepting tool submissions at this time, so the Platform has no form for proposing a tool. Being listed is free, and a Listing cannot be bought.
Providers and readers can still ask us to correct or update a Listing through the listing topic of our contact form, and a Provider can claim its Listing through the claim topic. We aim to reply within two business days, but we cannot promise any particular outcome.
What you confirm
By sending a Submission, you confirm that:
- you are at least 18 years old (or the age of majority where you live, if that is higher);
- if you say that you act for a Provider, you are authorized to do so (for example, as its founder, as an employee, or as an agency or freelancer acting with the Provider’s permission), and in any other case you are entitled to share the information you send;
- the information you provide is accurate, current, and not misleading; and
- neither the Submission nor our use of it under these Terms will infringe anyone’s rights or break any law.
The license you grant us
You keep any rights you own in your Submission. By sending it, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, store, display, publish, edit, adapt, and create derivative works from it in order to review it, create, update, and maintain Listings, and operate and promote the Directory and the Platform. Our service providers may exercise this license on our behalf.
The license lasts for as long as any Listing or content based on the Submission appears on the Platform, plus a reasonable period afterward for backups, record keeping, and legal compliance. To the extent the law allows, you waive, or agree not to assert against us, any moral rights in the Submission in connection with our edits. Text written by our editors, even where informed by your Submission, forms part of Our Content.
We handle your contact details as described in our Privacy Policy. We do not publish your email address, and Listings identify a tool’s developer rather than the person who contacted us about it.
Review, editing, and removal
We decide, at our discretion, whether and how to list a tool. We may act on a Submission or decline it without giving reasons; choose or change a Listing’s wording, category, tags, pricing-model label, and other details; and remove or suspend any Listing at any time, for example if a tool changes, stops operating, or no longer meets the criteria in our Editorial Policy.
Being listed does not guarantee any particular position, prominence, traffic, or duration. If you represent a Provider and want to correct or update your Listing, please use the listing topic of our contact form; to ask for its removal, use the report topic. We will consider every such request in good faith and may ask for reasonable evidence that you represent the Provider.
9. Editor’s picks, ordering, and sponsored placements
Editor’s picks
Editor’s picks are chosen by our editors on editorial grounds alone. They are never paid for and cannot be bought, including by clients of our Marketing Services.
How the Directory is ordered
Where the Platform shows a list of tools, Editor’s picks come first, followed by the most recently added Listings; our sitemap also lists every Listing alphabetically. Payment never influences the order of Listings, except that Sponsored Placements, when there are any, may appear in clearly labeled sponsored slots.
Sponsored labels
Any Listing whose Provider has a paid relationship with us, whether through a Sponsored Placement or because the Provider is a client of our Marketing Services, is labeled “Sponsored.” The “Visit website” link in a paid placement carries the rel="sponsored" attribute.
A “Sponsored” label means that a commercial relationship exists; it is not an endorsement. Sponsored Listings go through the same review as any other Listing, and payment does not buy an Editor’s pick or change our descriptions, pricing-model labels, or category choices. Our Advertising Disclosure explains these arrangements, including whether any Sponsored Placements are currently active.
10. Marketing services
We offer Marketing Services to AI and software companies: directory promotion, performance advertising, SEO and content marketing, and social media and KOL (creator and influencer) campaigns. They are described on our marketing services page.
A separate agreement applies
We provide Marketing Services only under a separate written proposal or agreement, which sets out the scope, deliverables, fees, payment terms, timelines, and each party’s responsibilities. For the services it covers, that document takes priority over these Terms if the two conflict.
Website content and quotes are not offers
We do not publish prices. Information about our services on the Platform is general and is an invitation to get in touch, not an offer that you can accept. Any proposal or quote we send is tailored to the prospective client and becomes binding only when both parties have agreed to it in writing.
No payments through the Platform
We never take payments through the Platform; payment terms for Marketing Services are set out only in the written proposal or agreement. If you receive a payment request that appears to come from us but does not match an agreement you have with us, please check with us through our contact form before paying.
No guaranteed results
Marketing results depend on factors outside our control, such as search engines, advertising and social media platforms, competition, and market conditions. We never guarantee rankings, traffic, leads, sales, or any other specific result.
Becoming a client does not buy editorial treatment (see Section 9), and we do not sell reviews, fake engagement, or pay-to-rank editorial content. To request a proposal, please use our contact form; you must meet the eligibility requirements in Section 4.
11. Intellectual property
Our Content
Our Content, including the Ankhway Marketing name and branding, the editorial text in Listings, the design and code of the Platform, the generated monogram tiles, and the selection and arrangement of the Directory, belongs to us or our licensors and is protected by copyright, trademark, and other laws.
We give you a limited, non-exclusive, non-transferable, revocable permission to view and use Our Content for your own information, including when you evaluate tools for yourself or for the organization you work for. You may share links to any page and quote short extracts, as long as you credit Ankhway Marketing and link back to the page. Any other copying, republication, sale, or commercial use requires our prior written permission.
Monograms and third-party names
Listing tiles show a generated letter monogram rather than the Provider’s logo. These monograms are a design element of the Platform; they are not the Provider’s marks and do not indicate any connection with the Provider.
Tool names, company names, trademarks, and other Third-Party Materials belong to their respective owners. We use them only to identify and describe the tools in the Directory. This use does not imply that any Provider endorses us, or that we endorse any Provider.
If you believe that content on the Platform infringes your rights, please see Section 13. All rights not expressly granted in these Terms are reserved.
12. Feedback
If you send us ideas, comments, or suggestions about the Platform or our services (“Feedback”), you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, adapt, and act on that Feedback for any purpose, without any obligation to pay or credit you.
Submissions are covered by Section 8 instead. Please do not include confidential information in Feedback. We are not obliged to act on any Feedback we receive.
13. Reports, corrections, and takedown requests
Please use the channel that matches your concern:
- Errors and outdated information. If a Listing is inaccurate or out of date (for example, a changed pricing model or a new website address), please tell us through our contact form, naming the Listing and explaining what needs to change.
- Harmful or unlawful tools or content. If you believe a listed tool is fraudulent, malicious, or unlawful, or that content on the Platform is unlawful or harmful, please report it with as much detail as you can.
- Copyright and other rights. If you believe content on the Platform infringes your copyright or other rights, please follow the process in our Copyright & Takedown Policy and use the copyright topic of our contact form.
- Providers updating their own Listing. Please see Section 8.
We review reports in good faith and decide what action, if any, to take. We may correct, suspend, or remove content while we look into a report. We aim to reply to contact form messages within two business days, although investigating and resolving a report can take longer. We may not be able to share every detail of our decision, particularly where other people’s information or rights are involved.
14. External links
The Platform links to websites we do not control, mainly through the “Visit website” link on each Listing, which opens the Provider’s site in a new tab. A link is not an endorsement, and we are not responsible for the content, accuracy, availability, security, privacy practices, or terms of any linked site.
Websites can change after we link to them, and web addresses can change hands. Before you download software, create an account, or enter personal or payment information on a linked site, check that it is the site you meant to visit.
You are welcome to link to any public page of the Platform, as long as you do so fairly and lawfully, do not suggest an endorsement or relationship that does not exist, and do not display the Platform within a frame on another website.
15. AI-specific risks
AI tools can be useful, but they have limitations that you should keep in mind whenever you use them.
- Outputs can be wrong. AI-generated text, code, images, audio, video, and analysis can be inaccurate, incomplete, out of date, or entirely made up, even when they sound confident.
- Outputs can be biased. AI systems can reflect biases in the data they were trained on and may produce offensive, discriminatory, or otherwise unsuitable content.
- Outputs can raise rights issues. Generated content may resemble existing works, brands, or real people. Check the Provider’s terms on who owns outputs and how you may use them, including commercially.
- Human review matters. Do not rely on outputs alone for legal, medical, financial, employment, safety-critical, or other important decisions.
- Automated actions need supervision. Agents and automation tools that send messages, change files, run code, or make purchases on your behalf can make mistakes quickly. Grant only the permissions a tool needs, and monitor what it does.
- Downloaded software needs care. If you install local or open-source AI software or model files, obtain them from sources you trust and check their license terms.
Do not upload or enter sensitive information into a Third-Party Tool, such as passwords or access keys, other people’s personal data, health or financial records, or confidential business information, unless you have checked how the Provider stores, uses, and shares it (including whether your inputs may be used to train models) and you are entitled to share it.
Your use of any Third-Party Tool, and of anything it produces, is at your own risk and is governed by the Provider’s terms. We are not responsible for the outputs of any Third-Party Tool.
16. Privacy
Our Privacy Policy explains how we collect and use personal information, including information you send through our forms, and the rights you may have. Messages and Submissions sent through our contact form are delivered to us by a third-party form-delivery service. Our Cookie Policy explains the browser storage and cookies the Platform uses.
Optional analytics and advertising cookies are used only if you agree to them. You can review or change your choice at any time through Cookie settings.
Please share only the information needed for your request, and do not send us other people’s personal information unless you are entitled to do so. We do not sell personal information.
17. Disclaimers
The Platform and all content on it are provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties or representations of any kind, whether express, implied, or statutory, about the Platform, any Listing, or any Third-Party Tool, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, completeness, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or free of errors or harmful components, or that any Third-Party Tool will meet your needs or be safe or lawful to use.
Content on the Platform is general information. It is not legal, financial, investment, tax, medical, security, or other professional advice. Our Disclaimer explains these points in more detail.
Nothing in these Terms affects any rights you have that cannot be excluded or limited by law, including any statutory rights you have as a consumer.
18. Limitation of liability
What we do not exclude
Nothing in these Terms excludes or limits our liability for:
- fraud or fraudulent misrepresentation;
- death or personal injury caused by our negligence; or
- any other liability that cannot be excluded or limited under applicable law.
Losses we are not responsible for
Subject to the paragraph above, and to the fullest extent permitted by law, we are not liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for:
- any loss or damage arising from your use of, or inability to use, any Third-Party Tool or linked website, or from any dealings between you and a Provider;
- any loss or damage arising from your reliance on any Listing, pricing-model label, or other content on the Platform, or on any AI-generated output;
- any loss of profits, revenue, business, contracts, goodwill, anticipated savings, or data, or any business interruption; or
- any indirect, incidental, special, or consequential loss, even if it was foreseeable or we were told it was possible.
Overall limit
The Platform is provided free of charge. For that reason, and subject to “What we do not exclude” above, our total aggregate liability to you for all claims arising out of or in connection with the Platform or these Terms is limited to US$100 (one hundred US dollars).
This section does not apply to Marketing Services provided under a separate written agreement; liability for those services is governed by that agreement. If the law where you live does not allow some of these limitations, they apply to you only to the extent that the law allows.
19. Indemnity
If you send us a Submission or misuse the Platform, you agree to indemnify and hold harmless M&R MARKETING GROUP, LLC and its members, managers, officers, employees, and contractors against all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from:
- your Submission, including any claim that it is inaccurate or misleading, or that it, or our use of it as allowed by these Terms, infringes someone else’s rights;
- your breach of these Terms, including the acceptable use rules in Section 5; or
- your breach of any law, or of any third party’s rights, in connection with the Platform.
We will let you know promptly about any claim covered by this section, and you agree to cooperate reasonably with us in dealing with it. If you use the Platform as a consumer, this section applies only to the extent permitted by the law where you live.
20. Availability, suspension, and termination
We aim to keep the Platform available, but we do not promise that it, or any page, Listing, or feature, will always be available. We may change, suspend, or discontinue all or part of the Platform at any time, and we are not liable if it is unavailable for any period.
We may restrict your access to the Platform, block traffic from particular sources, or stop processing your messages or Submissions if we reasonably believe that you have broken these Terms, that your activity threatens the security or operation of the Platform, or that the law requires us to do so.
Because there are no accounts, you can stop using the Platform at any time simply by no longer visiting it. If you want a Listing removed, see Section 8. Provisions that by their nature should continue afterward, including the license you grant us and the sections on intellectual property, Feedback, disclaimers, liability, indemnity, and governing law, continue to apply.
21. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to the Platform, our services, or the law. When we do, we will publish the updated version on this page and change the date shown at the top.
If we make a material change, we will take reasonable steps to draw attention to it, such as a notice on the Platform. Changes apply from the date they are published and do not apply to disputes that arose before that date. If you continue to use the Platform after a change takes effect, you accept the updated Terms. If you do not agree, please stop using the Platform.
22. Governing law and disputes
These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or the Platform, are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules.
The state and federal courts located in the State of Georgia have non-exclusive jurisdiction. This means that proceedings may also be brought in another court that has jurisdiction.
If you are a consumer, nothing in these Terms deprives you of the protection of mandatory consumer protection laws in your country of residence, or of any right you have under those laws to bring proceedings in your local courts.
Before starting formal proceedings, please contact us through our contact form or by mail, so that we can try to resolve the matter informally and in good faith. Nothing in this section prevents either party from seeking urgent relief from a court.
23. General
- Entire agreement. These Terms and the documents they refer to are the entire agreement between you and us about the Platform. Marketing Services are governed by a separate written agreement (see Section 10).
- Severability. If any part of these Terms is found invalid or unenforceable, it will be modified to the minimum extent necessary or removed, and the rest of these Terms will remain in effect.
- Assignment. We may transfer our rights and obligations under these Terms to another organization, for example as part of a sale of our business, if this does not reduce your rights. You may not transfer yours without our written consent.
- No waiver. If we delay or do not enforce any part of these Terms, we can still enforce it later. Any waiver must be in writing.
- Events beyond our control. We are not responsible for any delay or failure caused by events beyond our reasonable control, such as natural disasters, epidemics, war, government action, power or internet failures, cyberattacks, or failures of our service providers.
- No partnership or agency. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and us.
- Third-party rights. No one other than you and us may enforce these Terms, except that the persons protected by Section 19 may rely on it.
- Notices. We may give you notices by publishing them on the Platform or, if you have given us an email address, by email. You may give us notices through our contact form or by mail to our business address.
- Language. These Terms are written in English. If we provide a translation, the English version prevails if there is any conflict.
24. Contact
If you have questions about these Terms, please use our contact form. To report a problem with a Listing, choose the report topic; for copyright concerns, choose the copyright topic. We aim to reply within two business days (Monday to Friday, excluding US federal holidays).
